The Palace Of The Amanyanabo Of Ingeje Town, Kula Kingdom

OWNERSHIP OF BELEMA COMMUNITY: INGEJE MONARCH IN KULA KINGDOM REFUTES KALAORIYE’S PURPORTED CLAIMS

This is to inform the Rivers State Government, Akuku- Toru Local Government Council and the general public that the publication made in THE NEWSWRITER of September,1-7, 2016 edition with a caption,” STAY AWAY FROM BELEMA COMMUNITY’ AMANYANABO TELLS TROUBLE MAKERS “by one

Ibinabo Kalaoriye who claimed to be the founder and king of Belema community in Akuku- Toru Local Government Area of Rivers State is false and unfounded. So therefore, the general public should disregard this purported claim.

It is perlinent to put the record straight that Betema Community is been vehemently contested by viz: OPUEZE WAR CANOE ROYAL HOUSE OF INGEJE TOWN AND OKO FAMILY OF KULA TOWN ALL IN AKUKU- TORU LOCAL AREA OF RIVERS STATE. However, general public should vide proceedings and judgment of in Re Suit No. DHC/80/79 thereof wherein Coram Opene J as he then was delivered a judgment and upheld that INGEJE is one of fourteen (14) villages of kula kingdom and also in suit No. DHC /12/82 and DHC /14/83 wherein Opene J held that Oko is in the ward of Opueze 1. Belema Community is one of the fishing settlements within the INGEJE Territory founded and owned by my forbearer, Opueze 1, who settled Ibinabo Kalaoriye’s acclaimed ancestor, Oko who was a customary tenant to my forbearer when he(Oko) missed his way coming from Opu -Kula to the present Kula town. My forbearer Opueze 1, later resettled Oko in the present Kula town and gave him, his wife and his younger brother Kalaoriye with three(3) pieces of land vide also Suit No. DHC/12/82 and DHC/ 14/83 supra.

Secondly, a demonstration was staged against Shell Petroleum Development Company Nigeria Limited (SPDC) over surreptitious divestment of its OML 25 to another company named CRESTA which the various parties contesting the Belema Community seriously opposed to the handover of the said oil bloc to the aforesaid company (CRESTA), but rather the community urged SPDC to divest the OML 25 to our owned indigenous son’s company named and styled Belema Oil and Gas Company which was in the year, 2014 thereof without any controversy by anyone in the disputed community and it is surprising to observe in Ibinabo Kalaoriye’s publication after two (2) years to controvert the aforesaid demonstration and protest in 2014. However, kalaoriye silence after two (2) years and now attacking the said demonstration in 2016 appeared to be baseless and which can not impeached the fact of his admission because he can not at this stage approbate and reprobate, admit in one time and make a ‘u’ turn in another after two (2) years of silence. Moreso, Belema fishing settlement was upgraded to a community status by then council chairman of Akuku Toru Local Government Area in the 1992 in prejudice of Suit No. DCC/27/91.

Moreso, in Re Suit No. DHC/240/ 2006 thereof which Kalaoriye’s instituted for the court to interpret its consent judgment in Re Suit DHC/1969/99 wherein Coram Ugbari J as he then was, delivered a judgment against Kalaoriye by refusing his prayers and ordered that all the parties making claim to Belema Community are co-owners of disputed Belema community now, which parties are Opueze, Bourdillon and Kalaoriye, pending the final determination of the land matter in Suit No. DHC/63/2001 and DHC/64/2001 all consolidated which is still in subjudice before his Lordship Hon. Justice Enebeii J. Moreso, Coram Ugbari J, in his Obita dictum before the judgment admonished all the parties to keep alive the spirit of the consent judgment which is still operational without been set aside by any superior courts.

Further more, Kalaoriye’s claims to be the founder and king of disputed community in the said publication is seditious to the two (2) judgement of courts that is, in Suit No. PHC/1969/99 and PHC/ 240/2006 respectively. I therefore, give Kalaoriye seven (7) days from the date of this publication hereof to retract his purported publication as the founder and king of Belema Community otherwise I shall not hesitate to set down the machinery of law in motion against him by instructing my counsel chambers named “Opueze chambers” situated at no. 7 Aba Road, Port Harcourt for criminal prosecution on sedition of public documents.

It is germane to state here that Belema community is disputed and contested by two (2) families viz: Opueze Royal House of INGEJE Town and the Oko family of Kula Town wherein Bourdillon the head of Oko family and his junior brother, he brought from Harry’s town, Ibinabo Tanmunominji Harry are the representatives of the Oko family in Suit No.. DHC/63/2001 and DHC/64/2001 all consolidated and in subjudice.

Nevertheless, it is also important to state here that there is a pending chieftaincy matter restraining Kalaoriye and any other members of the Oko’s family from parading himself and themselves as the owner and king of Belema community which suit is before her Lordship Hon. Justice Suzzette Nyesom Wike in Suit No. PHC/2317/2001. So the anathema at which kalaoriye is posing to the general public he is the king and founder of the disputed Belema community is criminally seditious and contemptuous particularly when the subject matter above are still in trial and judgments are yet to be delivered by the aforesaid courts and in order for him to make such an assertion is an abuse of court and contemptuous to court proceedings to the matters in courts and particularly disturbing the Res (subject matter) why we are both in courts.

In any case, Kalaoriye claims to have a judgment in his favour is laughable because the subject matter is in trial and parties challenging the aforementioned subject matter with him are not parties to the judgment he acclaimed to have and so therefore the judgment is of no significant due to the fact that it is not binding on the persons he alleged to be trouble makers in his publication. Professionally speaking, I and his elder brother, Bourdillon are not parties to the Kalaoriye’s said judgment thereto which simply means that the acclaimed won judgment is not binding in any of us contesting the ownership and chieftaincy matter and as such the judgment is worthless and amounts to judicial rascality.

Professional speaking, a judicial battle is not fought in the print and electronic media, but fought in preponderant of evidence upon which judgment is delivered. So what my rival party in his publication is doing is to fight a judicial battle in the said print and electronic media in order to phish evidence which is an abuse and contemptuous as earlier aver. It is pertinent to state at this junction that INGEJE Town is not in dispute, I am presently the Amanyanabo and my forbearer Opueze 1, was the peaceful and actual founder of INGEJE Town wherein Belema community is situated and to support this claim the proceedings judgment of Coram Opene J. Vide Supra.

Finally, Kalaoriye’s attack on one of our sons, namely Jackrich Tein Jr. Who is the Chief Executive Officer (CEO) of Belema Oil and Gas Company is maligning and libelous to the integrity of our son who is a native of Belema community and of Oko family. However, Mr. Jackrich Tein Jr. has assisted the community various in ways particularly awarding surveillance contracts to engage some youths in the community for employments and which Kaiaoriye’s two (2) sons are beneficiaries of Jackrich Tein Jr., community employment. All the same, I look forward to the public to discountenance any other further publication by Kalaoriye, as being devious to publish evidence through this medium and to bring the court proceedings into the print and electronic sphere for contest. I therefore, urge the courts and his counsel to call him to order.
